Thank you for registering and selecting this website offered by Fluid Modeling Group Canada, Inc. (FMG) for your needs for fluid property and phase behavior calculations in the technical domains of the Environmental and Oil and Gas industries. This Terms of Service & Conditions is a legal agreement between you and FMG. By clicking "I Agree", you agree to these terms. If you do not agree to this Agreement, you may not use our services.
1. Agreement
This Agreement describes the terms governing your use of the FMG online services (Services) provided to you on this website. FMG is committed to protect your privacy data and materials, and will not release them to the third party without your written permission (see Privacy Statement).
2. Your Right
2.1. The Services FMG provides to you are protected by copyright, trade secret, and other intellectual property laws. As long as you comply with this Agreement and fulfil the payment obligations, FMG grants your right to use the non-exclusive, non-transferable Services.
2.2. You agree not to provide access to the Services and its contents to any third party, nor reproduce, copy, trade or modify the Services to any third party without the permission from FMG.
3. Use of Mobile Devices
Beside of desktop computers, you may use mobile phones and laptop computers to access and use the Services. As to the availability or interruption of telecommunication services from your provider in using the Services at any time or from any location, which may result in any data loss, damage or failure to transmit any data or causing other security issues, FMG makes no warranties or takes no responsibilities to any kind of the situations.
4. The Contents (Data and Materials)
You take the full responsibility in using the Services to upload, post, transfer or store your contents including any third party’s contents that might be involved in copy right or intellectual property. FMG is not responsible for your contents (data or materials) you submit through the Services.
Your feedbacks, comments and suggestions on the Services are most welcome. You agree that FMG has the right to use your feedbacks and suggestions to modify and improve our future services and use them in advertising and marketing materials.
5. Technical Support
5.1. We provide the technical support free of charge to the users who have paid for the Services. We reply to any issues you may raise within 5 business days.
5.2. The payment for using the Services does not include the professional consulting services, which may be provided through quotations. During the consultation, you grant us permission to use your business data or materials and agree that we may communicate with you via email or by posting them on our websites.
5.3. We do our best to assure the continuity of the Services. If there is any unpredicted breakdown that results in the failure to access to our website, we will solve the issue within the next business day.
5.4. We carry on the maintenance service on a regular basis. The date and time for the maintenance service is posted on the website. During the period of maintenance service, the Services may be suspended temporarily.
5.5. You manage your account and access password. Should you become aware of any unauthorized access to your account, please contact us immediately.
5.6. We periodically update and upgrade the Services to improve our services to you. You agree to accept these updates.
6. Disclaimer
Your use of the Services and the results calculated by the Services is entirely at your own risk. FMG makes on warranty that the Services are absolutely accurate, precise, and free from errors and bugs or possible virus invasion. FMG retains the final interpretation of all the contents of this website.
7. Refund
A certain free trail is provided to the new user. Then a payment based on a business model of “pay as you go" is required (see Instructions for Use). If the user requests to stop using the Services, any unused portion of the previous payment would be refunded.
8. Changes
FMG reserves the right of change this Agreement at any time, and the changes will be effective through the posting on this website. Your continued use of the Services indicates that you agree to the changes.
9. Termination
FMG has the right to terminate or suspend the use of the Services if you fail to comply with this Agreement and reserve the right in its sole discretion to refund or not the unused portion of the payment.
10. Governing Law
The province laws of Alberta and the federal laws of Canada govern this Agreement.
